Fair Usage Policy
- Purpose - This Fair Usage Policy (“Policy”) ensures that the Subscription Services provided by Decidr are used equitably, fairly, and within agreed parameters to prevent excessive use or misuse. This Policy is intended to safeguard the performance, security, and reliability of the Subscription Services for all Clients.
- Scope - This Policy applies to all Clients and Authorised Users as defined in the Agreement. Usage of the Subscription Services must align with the applicable Usage Metrics specified in the Order or Documentation.
- Acceptable Use - Clients and Authorised Users are required to:
- Use the Subscription Services within the limits defined by their agreed Usage Metrics, including but not limited to data storage, API requests, processing power, and concurrent access.
- Ensure that all usage of the Subscription Services supports the internal business purposes of the Client as outlined in the Agreement.
- Maintain the integrity of their access credentials and limit access to authorised personnel only.
- Prohibited Use - Clients and Authorised Users must not:
- Exceed the limits specified in the applicable Usage Metrics, including but not limited to storage capacity, API calls, or processing time.
- Use the Subscription Services in a manner that causes disproportionate strain on Decidr’s systems or adversely affects other Clients’ ability to access and use the Subscription Services.
- Employ automated tools or systems, such as bots or scrapers, to bypass usage restrictions or consume resources beyond what is permitted.
- Circumvent or manipulate monitoring tools designed to enforce usage limits.
- Grant unauthorised third parties access to the Subscription Services.
- Monitoring and Enforcement - Decidr may monitor usage to ensure compliance with this Policy. Actions that may be taken in response to violations include:
- Notification of excessive usage, requesting immediate remediation.
- Temporary or permanent suspension of specific functionalities or access to the Subscription Services if excessive usage persists.
- Charging additional fees for overages, calculated in accordance with the terms of the Agreement.
- Termination of access for severe or repeated violations, as permitted under the Agreement.
- Temporary Usage Spikes - Decidr understands that legitimate business activities may occasionally result in temporary usage spikes. In such cases, Clients are encouraged to notify Decidr in advance. Decidr will endeavour to accommodate such needs, provided they are within reasonable limits and do not compromise service quality for other Clients.
- Amendments - This Policy may be updated or modified by Decidr to address changing operational, technological, or business requirements. Any material changes will be communicated to Clients in accordance with Clause 11.9 (Notices) of the Agreement. Continued use of the Subscription Services constitutes acceptance of the revised Policy.
